Brokerage in India is conventionally 1% from each side on a sale in most cities — up to 2% in some markets and on smaller tickets. On a rental the norm is one to two months' rent, again typically collected from both landlord and tenant.

This works out what you actually take home: gross commission, GST if you are registered, and your share after any split with a co-broker.

GST on brokerage

Real estate agency is a service taxed at 18% GST. Registration is mandatory once your turnover crosses ₹20 lakh a year (₹10 lakh in special category states). Below that you can operate unregistered and simply not charge GST. Once registered you must invoice GST on every deal, file returns, and you can claim input credit on business expenses.

A worked example

An ₹80 lakh resale at 1% from both sides is ₹1,60,000 gross. Split 50/50 with the co-broker who brought the buyer leaves you ₹80,000; add 18% GST and you invoice ₹94,400, of which ₹80,000 is yours and ₹14,400 goes to the government.

Brokerage is not statutorily fixed in India. Agree the rate, the sides and the payment trigger in writing before you show the property — most disputes are about when commission becomes due, not how much.

What is the standard brokerage in India?

One per cent from each side on a resale is the most common convention in metros, with 2% seen in smaller markets and on low-value deals. Builder projects pay the agent 2–5%, funded entirely by the builder.

Is GST applicable on brokerage?

Yes, at 18%, once you are registered. Registration becomes mandatory above ₹20 lakh of annual turnover (₹10 lakh in special category states).

When is brokerage payable?

Usually on registration of the sale deed for a sale, and on signing the leave-and-licence agreement for a rental. Put the trigger in writing — "on token" versus "on registration" is the single most common source of disputes.

Can brokerage be negotiated?

Almost always, particularly on higher-value deals where a flat fee often replaces a percentage. Agents with exclusive mandates and better marketing hold rates more successfully.

Do I need a RERA registration to charge brokerage?

Yes. Agents dealing in RERA-registered projects must hold a RERA agent registration in that state, renewed periodically. Operating without one carries penalties.
