Stamp duty is a state tax on the transfer of property, paid before the sale deed is registered. It is charged on the higher of the agreement value or the government-notified circle rate (called ready reckoner rate in Maharashtra, guidance value in Karnataka), so a below-circle-rate deal does not reduce the duty.

Several states charge women buyers 1–2% less, which on an ₹80 lakh flat is worth ₹80,000 to ₹1,60,000 — often the single cheapest saving available in the transaction.

How stamp duty is charged

Duty is a percentage of the higher of the agreement value and the state's notified circle rate. Registration is usually a separate 1%, capped in some states. Both are paid before the sub-registrar will register the deed, and both are due in full at registration — no lender funds them.

These are indicative. States revise duty in the budget, cities add metro cess or local body tax, and slab rates apply in Karnataka and West Bengal by value. Always confirm the current figure with the sub-registrar or the state IGR portal before you budget.

A worked example

An ₹80 lakh flat in Pune bought in a woman's name: duty at 5% is ₹4,00,000, registration at 1% is capped at ₹30,000, so ₹4,30,000 — against ₹5,10,000 if bought in a man's name. The concession alone is ₹80,000.

Frequently asked questions

Is stamp duty calculated on the agreement value or circle rate?

On whichever is higher. If you buy below the circle rate, duty is still charged on the circle rate, and the difference can also be taxed as income under Section 56(2)(x) beyond a 10% tolerance.

Do women pay less stamp duty in India?

In several states, yes — Delhi (4% vs 6%), Maharashtra (5% vs 6%), UP, Haryana, Punjab and Rajasthan all offer 1–2% off. Karnataka, Tamil Nadu and Gujarat charge the same regardless of gender.

Can I claim stamp duty on tax?

Yes. Stamp duty and registration charges qualify under Section 80C, but only in the financial year they are actually paid, and within the overall ₹1.5 lakh 80C limit shared with EPF, insurance and principal repayment.

Can stamp duty be paid in instalments?

No. It is due in full before registration. Unregistered agreements are not admissible as evidence of title, so this is not a cost you can defer.

Is stamp duty charged on resale property too?

Yes. Any transfer of ownership attracts duty, whether the property is new, under construction or a resale.
