Where registration does apply — and it is compulsory for leave and licence agreements in Maharashtra regardless of term — stamp duty is charged on a formula that includes both the rent and the deposit.
Maharashtra uses the clearest rule in the country: 0.25% of the total rent for the term plus 10% of the refundable deposit. Other states mostly use flat slabs or a small percentage.
The Maharashtra formula
Stamp duty = 0.25% × [ total rent for the term + non-refundable deposit + (10% of the refundable deposit) ]
Registration fee: ₹1,000 urban, ₹500 rural.
Registering a leave and licence agreement in Maharashtra is compulsory under Section 55 of the Maharashtra Rent Control Act, whatever the term, and can be done online through the IGR portal with Aadhaar-based e-registration.
A worked example
₹25,000 a month for 11 months with a ₹3,00,000 refundable deposit in Pune: total rent ₹2,75,000, plus 10% of the deposit (₹30,000) = ₹3,05,000. Duty at 0.25% is ₹763, plus ₹1,000 registration = ₹1,763, conventionally split between landlord and tenant.
Why 11 months
Section 17 of the Registration Act makes a lease of one year or more compulsorily registrable. An 11-month agreement sidesteps that in most states — but not in Maharashtra, where leave and licence registration is mandatory regardless. An unregistered agreement where registration was required is not admissible as evidence, which matters if you ever need to enforce it.

Is an 11-month rent agreement legal in India?
Yes, and it is the norm precisely because leases of twelve months or more must be registered. In Maharashtra, leave and licence agreements must be registered regardless of the term.
Who pays the stamp duty on a rent agreement?
There is no statutory rule. Convention is to split it equally between landlord and tenant, but it is negotiable and should be stated in the agreement.
Is a notarised agreement enough?
Notarisation is not registration. Where registration is legally required, a notarised agreement will not be admissible as evidence of the tenancy in court.
Can I register a rent agreement online?
In several states, yes. Maharashtra offers full e-registration with Aadhaar authentication through the IGR portal, and Delhi and Karnataka have e-stamping.
